Inadequate Rubbish Collection Arrangements
Often, multiple floors mean conventional bins aren’t suitable or practical for binmen to collect. High Tenant Turnover
There can be a high turnover of tenants in blocks, which can create confusion at the end of a tenancy over who is responsible for collecting any items of waste which the tenant no longer wants, particularly larger items (is it classified as commercial or household waste?) – tenants are only responsible for day-to-day waste under the law.
This can create an issue where tenants can’t always take larger items down to the local council site, and the binmen won’t collect it if they deem it to be commercial waste. Skips Aren’t Always the Answer
Hiring a skip to collect excess waste or any larger items isn’t always the answer either. Aside from any permissions you may need if the skip needs to go on a public highway, there will always be the temptation for anyone to dump their unwanted possessions in it (not necessarily block residents). Under UK law, the person who hires the skip is responsible for its contents, even if someone else has added to it.
This is a concern as certain items should not go in skips, such as:
- Hazardous materials such as paints, solvents and asbestos
- Electrical equipment (under WEEE regulations)
- Perishable food waste
- And tyres and gas cylinders.
If any of these are found inside your skip, not only may the skip hire company refuse to collect it until they are removed - posing a question of what to do with this waste. You may be subject to a fixed penalty notice from your local council or a fine of up to £5,000 under the Environmental Protection Act 1990, if these are found at your site and not removed promptly.
